Rental Terms

TO: Franks Finnis Sauna, and its directors, officers, employees, contractors, agents, volunteers, representatives and assigns (collectively, the “Releasees”)

A. ACTIVITIES:

In this Release Agreement, “Activities” means all activities, events, services, or equipment provided, arranged, organized, sponsored or authorized by the Releasees, including but not limited to: use of the sauna and sauna trailer (including stairs, benches, and wood-burning stove area), any other equipment or amenities (including chairs, firewood, fire extinguishers) provided by the Releasees, as well as yoga and other wellness experiences.

B. ASSUMPTION OF RISKS:

I am aware of and acknowledge the risks associated with my participation in the Activities, including without limitation, physical injury, illness, paralysis, death or damage to myself, property or third parties; slips, trips and falls on slippery uneven surfaces such as stairs, sauna flooring and benches; hot and cold weather exposure; using sauna facilities in inclement weather including storms, lightning, and high wind; limited access to and/or delay of medical attention; participants’ health condition; exhaustion; dehydration; heat-related illnesses; inability to act safely or within one’s ability; negligence or failure of other persons to act safely; equipment failure or malfunction (including malfunction of fire extinguisher); burns from hot steam or hot metal contact, chimney flu exhaust gases, firewood handling and hot coals, incendiary devices/agents such as firestarter sticks/logs, butane lighters/torches; pinch points and crush hazards while loading firewood; overhead hazards including but not limited to door jams, roof eves, chimney flu, wood storage box.

I understand that I should not use sauna if I have any underlying health issues including but not limited to high blood pressure, diabetes, heart failure, abnormal heart rhythm, unstable angina, or if I am pregnant or planning to become pregnant and agree that it is my responsibility to consult a physician before sauna use.

I acknowledge it is my responsibility to familiarize myself with the instructions provided by the Releasees relating to the use and operation of the sauna and sauna trailer.

I acknowledge AN UNQUALIFIED ASSUMPTION BY ME OF ALL RISKS AND HAZARDS, whether or not described above, known or unknown, inherent or otherwise, associated with my participation in the Activities, including but not limited to personal injury, illness, paralysis, death or damage to myself, property or third parties associated with my participation in the Activities, even if arising from the negligence or gross negligence, including any compounding or aggravation of injuries caused by negligent rescue operations or procedure, of the Releasees, and any persons associated therewith or otherwise participating in the Activities in any capacity.

C. RELEASE, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT:
In consideration of the Releasees allowing me to participate in the Activities, I agree as follows:

TO WAIVE ANY AND ALL CLAIMS that I have, or may in the future have, against the Releasees AND TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury or expense that I may suffer as a result of my participation in, or my presence in any capacity at, the Activities, due to any cause whatsoever, INCLUDING NEGLIGENCE, GROSS NEGLIGENCE, BREACH OF CONTRACT, NEGLIGENT REPRESENTATION AND/OR EXPRESS OR IMPLIED WARRANTY OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT ON THE PART OF THE RELEASEES. I understand that negligence includes failure on the part of the Releasees to take reasonable steps to safeguard or protect me from the risks and hazards of the Activities.
RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT (the “Release Agreement”) BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION IN THE EVENT OF INJURY.
PLEASE READ CAREFULLY

NOT TO SUE THE RELEASEES for any loss, injury, costs or damages of any form or type, howsoever caused or arising, and whether directly or indirectly, from my participation in, or my presence in any capacity at, the Activities.

TO INDEMNIFY AND HOLD HARMLESS THE RELEASEES, and each of them, from any expense, legal fees, liability, damage, award or cost, of any form or type whatsoever, they may incur resulting from my participation in, or my presence in any capacity at, the Activities.

This Release Agreement shall be effective and binding on my heirs, next of kin, executors, administrators and assigns.

This Release Agreement is governed by the laws of Saskatchewan. In entering into this Release Agreement, I confirm I am not relying on any oral or written representations or statements made by the Releasees with respect to the safety of the Activities, other than what is set out in this Release Agreement.

TO MAINTAIN A FULL LOOK, FILLS AT THE 2-3 WEEK MARK ARE RECOMMENDED.

I HAVE READ AND UNDERSTAND THIS RELEASE AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN SUBSTANTIAL LEGAL RIGHTS WHICH I AND MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE AGAINST THE RELEASEES.

RENTAL TERMS AND CONDITIONS OF USE

This Rental Agreement (“Agreement”) must be signed by the principal “Renter,” defined as the individual who holds the reservation and/or pays the majority of the rental fee. The renter must be at least 18 years of age.

PARTIES:

Owner:
Frank's Finnish Sauna LLC, a New Hampshire limited liability company, including its members, managers, officers, employees, contractors, agents, volunteers, representatives, and assigns (collectively, “Frank's Finnish Sauna LLC”).

Renter:
The undersigned individual executing this Agreement.

DESCRIPTION OF RENTAL

Frank's Finnish Sauna LLC agrees to rent to the Renter a mobile wood-burning sauna trailer (the “Sauna”) subject to the terms and conditions of this Agreement.

RENTER’S ACKNOWLEDGMENTS AND AGREEMENTS

By signing this Agreement, the Renter acknowledges and agrees as follows:

1. ASSUMPTION OF RISK
I understand that use of a wood-burning sauna involves inherent and obvious risks, including but not limited to burns, heat exhaustion, dehydration, dizziness, fainting, smoke inhalation, fire hazards, slips and falls, equipment failure, and injuries caused by my own actions or the actions of others. I voluntarily and knowingly assume all risks, whether known or unknown, foreseeable or unforeseeable, arising out of or related to the rental, presence at the rental location, or use of the Sauna.

2. RELEASE OF LIABILITY
To the fullest extent permitted by New Hampshire law, I, on behalf of myself, my heirs, assigns, guests, invitees, and any minors under my supervision, release, waive, discharge, and covenant not to sue Frank's Finnish Sauna LLC from any and all claims, demands, causes of action, damages, losses, or liabilities arising from ordinary negligence or otherwise, related to:

Use or misuse of the Sauna

Presence at the rental location

Fire, heat, steam, or stove-related hazards

Acts or omissions of guests or third parties

Personal injury, death, or property damage

This release does not apply to gross negligence or willful misconduct to the extent prohibited by law.

3. INDEMNIFICATION
I agree to defend, indemnify, and hold harmless Frank's Finnish Sauna LLC from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

My breach of this Agreement

Failure to obtain signed waivers from guests

Injury or damage caused by me or my guests

Use or misuse of the Sauna

Presence of unauthorized guests or minors

This obligation survives the rental period.

4. GUEST RESPONSIBILITY & AGENCY
I acknowledge that I act as the responsible party and agent for all guests, invitees, and minors present during the rental period. Any violation of this Agreement by a guest shall be deemed a violation by me.
I am responsible for ensuring all guests sign the required Waiver prior to Sauna use.

5. MINORS & SUPERVISION
Any person under 18 years of age must be accompanied at all times by a parent, legal guardian, or responsible adult who has read and signed the Waiver. Guests requiring physical or medical assistance must always be accompanied by another adult.

6. NO MEDICAL ADVICE / FITNESS TO USE
Frank's Finnish Sauna LLC provides no medical advice. I represent that I and my guests are medically and physically fit to use a sauna and understand that sauna use may aggravate existing medical conditions, including heart conditions, pregnancy, respiratory conditions, or heat sensitivity.

7. REQUIRED PRESENCE
The Renter must be present at the rental location at all times while the Sauna is in use.

SAFETY RULES AND OPERATING REQUIREMENTS

A. FIRE EXTINGUISHER

Renter must read all fire-extinguisher instructions prior to use.

Renter must know the extinguisher’s location at all times.

B. HEALTH & SAFETY GUIDELINES

Avoid alcohol or drug use while using the Sauna

Recommended maximum sauna times:
- Adults (18+): 20 minutes
- Ages 13–18: 15 minutes
- Ages 9–12: 10 minutes
- Ages 5–8: 5 minutes
- Ages 0–4: 3 minutes

Hydrate before, during, and after use

Monitor children closely for heat stress

C. PROHIBITED ACTIVITIES

Use while ill

Jewelry, metal objects, alcohol, drugs, smoking, vaping

Food, pets, glass, sharp objects, fire accelerants

Climbing on the Sauna or trailer

Crossing stove guard barrier

Sexual activity

D. FIRE STARTING

Use only provided ignition tools

Stove door must remain closed except when loading wood

Burn only dry, untreated, unpainted wood

E. OPERATION & HEAT MANAGEMENT

Maximum occupancy: 6 people

Only fresh water may be poured on rocks

Do not pour water on stove surfaces

Electronics are prohibited inside the Sauna

Open door for ventilation if overheated

Cold-water access recommended

Frank's Finnish Sauna LLC is not liable for damage to personal items.

DROP-OFF & PICK-UP

Delivery and pick-up times are scheduled by mutual agreement.

Renter must provide a flat, authorized, private location suitable for wood-burning operation.

Trailer size is 18 by 8 feet and must be parked in an area where the stove pipe will not be close to anything.

Unsuitable locations constitute a late cancellation with no refund.

Sauna must not be moved after setup.

Fire must be fully extinguished and stove cool at pickup. Hot embers will result in an additional day’s rental charge.

PAYMENT, DEPOSIT & CLEANING

$500 damage deposit due at drop-off

Rental fee: 50% at booking, 50% at drop-off

Renter is responsible for damage, loss, or excessive cleaning caused by misconduct

Deposit applied toward costs; excess due within 7 days

Sauna cleaned before and after rental

CANCELLATION POLICY

More than 48 hours: full refund

24–48 hours: 50% refund

Less than 24 hours: no refund

PRICING & DELIVERY

Rates vary by demand and duration

Delivery fee: $1.50 per Mile outside of 25 miles

One complimentary box of firewood included , 12 inch stove belly.

Additional firewood: $10 per bundleShape

LIMITATION OF LIABILITY
To the fullest extent permitted by law, Frank's Finnish Sauna LLC’s total liability shall not exceed the total rental amount paid. No liability for indirect, incidental, consequential, or punitive damages.

SEVERABILITY
If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

WAIVER OF JURY TRIAL
The parties knowingly and voluntarily waive the right to a trial by jury in any dispute arising from this Agreement.

GOVERNING LAW & VENUE
This Agreement shall be governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles. Venue shall lie exclusively in New Hampshire state or federal courts.
